LEGAL RESEARCH

Legal scholarship.
In practice.

Legal research is integral to The Immigration Lawyer’s approach to immigration and nationality law.

Our work draws on the systematic study of legislation, case law and legal doctrine, with particular attention to the relationship between Dutch law, European Union law and international legal obligations.

Scholarly
foundation.

Sound legal analysis requires more than familiarity with the applicable rules. It requires an understanding of their origins, underlying principles and place within the wider legal system.

We examine questions of interpretation, developments in judicial reasoning and the coherence of legal frameworks. Academic literature and comparative perspectives help place these questions in their wider legal context.

Areas of
attention.

Immigration and nationality law.

The structure and development of the legal frameworks governing residence, international mobility and nationality. Particular attention is given to the interaction between national and supranational rules, and to questions extending across jurisdictions.

Legal interpretation and judicial developments.

The interpretation of statutory provisions, the significance of emerging case law and the relationship between judicial decisions and administrative practice. Analysis distinguishes established doctrine from competing interpretations and questions that remain unsettled.

Fundamental rights and legal protection.

The role of fundamental rights, general principles of law and procedural safeguards in immigration and nationality matters. Areas of attention include proportionality, legal certainty and effective judicial protection.

Scholarly
engagement.

Critical engagement with legal scholarship forms part of our research. We consider competing arguments, examine the assumptions behind them and assess their significance for immigration and nationality law.

Through research and the exchange of ideas, we seek to contribute to informed legal discussion and the continuing development of knowledge in these fields.

Informed
practice.

Research informs the way we analyse complex legal matters. By examining underlying principles, alternative interpretations and developments across legal systems, we develop carefully reasoned advice and assess the legal possibilities in context.

Questions encountered in practice can also identify issues for further study. This continuing exchange between scholarship and practice deepens our understanding of the law and its application.
